Carol recently received summary judgment from the U.S. District Court, Northern District of Indiana, for three medical providers at the Westville Correctional Facility. The Court held that based on the opinions of the Defendants and the facts of their medical care, they responded timely to each of the Plaintiff's complaints and Plaintiff could not meet his very high burden under the "deliberate indifference" case law. One of Plaintiff's issues was that he was prescribed Pamelor, a tricyclic anti-depressant, off label for chronic pain. The Court pointed out that prescribing drugs for off-label uses is common practice and certainly does not equate to medical malpractice.
