Carol Dillon recently received summary judgment in federal court for two doctors and the company they worked for. One of the doctors altered a patient’s medication and the other doctor monitored the patient thereafter. The patient happened to have a bad reaction to the medication and was admitted to the hospital. Plaintiff initially filed a negligence claim and a federal claim, but relinquished the federal claim after the doctors filed for summary judgment, supported by Affidavits with the specific rationale for treating the patient the way they did. The Defendants testified on their own behalf that they met the standard of care and Plaintiff never disclosed an expert until a year after the deadline and after Defendants filed their summary judgment motion. The Plaintiff had to go all the way to the east coast to find a supportive expert. The Court correctly excluded Plaintiff’s expert testimony as untimely and granted Defendants’ Motion for Summary Judgment.
