Carol Dillon recently won summary judgment for her clients, a local physician and nurse practitioner, after three years of litigating a civil rights case involving medical care. The issue was a failure to timely diagnose cancer and when Plaintiff’s cause of action accrued under federal law. The Court agreed with the medical providers, that Plaintiff’s cause of action accrued when he received the diagnostic tests, not when he received his diagnosis. Although Defendants also had a summary judgment motion pending on the merits of Plaintiff’s case, the Court did not address that Motion, since it agreed that Plaintiff’s Complaint was untimely.
